Definition and subject matter of the contract
This is a distance contract pursuant to Article 50 et seq. of Legislative Decree No. 206 of 6 September 2005 (‘Consumer Code’). The contract concerns the sale of movable goods between Arbatus Alicudi Snc, with registered office in Via Roma, 18 – 98050 – Alicudi (ME) – VAT number 02748150832 (‘Arbatus Alicudi’) and the consumer (the ‘Customer’). The Contract is concluded directly through the acceptance by Arbatus Alicudi of a purchase proposal issued by the Customer via the internet on the website www.eolietrekking.com (the ‘Site’).
Purchase and payment methods
The Customer will be allowed to choose one of the following payment methods:
(a) Bank transfer
(b) PayPal
(c) any other means of payment indicated as valid by Arbatus Alicudi from time to time through the transmissions on the Website.

Product availability
Arbatus Alicudi will fulfil Customer orders within the limits of the quantities of products requested that are available in stock. Therefore, Arbatus Alicudi’s acceptance of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Arbatus Alicudi undertakes to promptly notify the Customer of any unforeseen stock shortages due to excess demand or other causes.
Warranties and assistance
For products purchased by the Customer, Arbatus Alicudi is subject to the rules on warranties and assistance relating to the sale of consumer goods.
Customer obligations
The Customer declares and guarantees: that they are a consumer as defined in Article 3 of the Consumer Code; that they are of legal age; that the data provided by them for the execution of the Contract is correct and truthful.
Right of withdrawal
The Customer has the right to return the purchased product, without penalty and without specifying the reason, within 10 days of receipt of the products. The Customer may exercise the right of withdrawal within the aforementioned period by sending a written notice by registered letter with acknowledgement of receipt to Arbatus Alicudi Snc – via Roma, 18 – 98050 Alicudi (ME) -Italy. Customers who wish to exercise their right of withdrawal must return the products to the address indicated on the invoice, following the instructions provided therein, within 30 days of receipt of the products. The costs of returning the products are borne by the Customer.
Arbatus Alicudi will refund, within 10 days of receipt of the products by the Customer:
(I) the full price paid by the Customer in the event of return of the product complete with all its parts and functionality.
Competent court
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the Contract shall be settled by the Court of Messina.
Force majeure
In any case of force majeure or unforeseeable circumstances, Arbatus Alicudi shall not be held liable for any delay or failure to deliver and reserves the right to terminate the contract in whole or in part, suspend or defer its execution.
