Definition and subject matter of the contract
This contract (“Contract”) is a distance contract within the meaning of Art. 50 et seq. Of Legislative Decree No. 206 of September 6, 2005 (“Consumer Code”). The Contract has as its object the sale of movable goods between Arbatus Editrice srl, with registered office in Via Regina Elena, 16 – 98050 – Alicudi (ME) – P.IVA 02748150832 (“Arbatus Editrice”) and the consumer (the “Customer”) The Contract is concluded directly through the acceptance byArbatus Editrice of a purchase proposal issued by the Customer via the Internet on the website www.eolietrekking.com (the “Site”)
Method of Purchase and Payment.
The Customer will be allowed to choose one of the following payment methods
(a) Bank Transfer
(b) PayPal
(c) by any other means of payment from time to time indicated as valid by Arbatus Editrice through transmissions on the Site
Delivery of products – complaints
Arbatus Editrice delivers products to the address indicated by the Customer within 24/48 hours after receipt of payment.

Availability of products
Arbatus Editrice the Customer’s orders within the limits of the quantities of the requested products existing in stock. Therefore, Arbatus Editrice’s acceptance of the purchase proposal forwarded by the Customer is subject to the stock availability of the products themselves. Arbatus Editrice undertakes to promptly notify the Customer of any unpredictable out-of-stocks due to excess demand or other causes.
Warranties and assistance
For the products purchased by the Customer, the regulations regarding warranties and assistance relating to the sale of consumer goods are applicable to Arbatus Editrice.
The Customer represents and warrants: that he/she is a consumer in accordance with the provisions of Article 3 of the Consumer Code; that he/she is of legal age; that the data provided by him/her for the execution of the Contract are correct and true.
Right of withdrawal
The Customer has the right to return the purchased product, without any penalty and without specifying the reason, within 10 days from the receipt of the products.The Customer may exercise the right of withdrawal, within the above-mentioned period, by manifesting it through a written communication, registered letter with return receipt to Arbatus Editrice srl – via Regina Elena, 16 – 98050 Alicudi (ME) -Italy. The Customer who intends to make use of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 30 days of receipt of the products. The cost of returning the products shall be borne by the Customer.
Arbatus Editrice will return, within 10 days from the date of receipt of the products by the Customer:
(I) the full price paid by the Customer in case of return of the product complete with all its parts and functionality; or
(II) the portion of the price equivalent to the product actually returned by the Customer who has worn out the product appreciably and/or to such an extent as to significantly diminish its value.
Jurisdiction
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the Contract shall be within the jurisdiction of the Court of Vicenza.
Force Majeure
In any case of force majeure or fortuitous event, Arbatus Editrice shall not be held responsible for delay or non-delivery and reserves the right to terminate all or part of the Contract, suspend or postpone its execution.
